Judgments and preliminary rulings on infringement and enforcement of industrial and intellectual property rightsThe Observatory of the European Intellectual Property Office (EUIPO) has a database on its website that compiles judgments on industrial and intellectual property rights from all the Member States of the European Union. It is available through the eSearch case law database link. This compilation of judgments makes them very easy to consult, as the database has filters that allow the search to be limited by date, language, type of decision, court of origin, among others, thus speeding up the search for cases. The initiative started in 2014 and involves national industrial property offices and the Community Plant Variety Office (CPVO). In 2020, the Observatory launched an extension to collect the main national IPR infringement judgments to try to cover the missing Member States and make the information available to the public through the database. National experts, volunteer expert reviewers and independent reviewers, who are responsible for selecting and analyzing key national IPR infringement judgments, carry out this task. The list of participants in this activity is available at the following link. In addition, the Observatory also monitors cases in the framework of the European Network of Intellectual Property Prosecutors and decisions of the Court of Justice of the EU related to IPR infringement.
