Este instrumento otorga a su titular una protección de 20 años (pudiendo prologarse en el caso de medicamentos y productos fitosanitarios) y durante este periodo de tiempo el inventor posee el derecho de uso exclusivo de la invención, permitiéndole impedir que terceros, sin autorización hagan uso de ella.
