Filing an international PCT application

 

With the international PCT application, by filing a single application, you can protect your invention in all countries that are party to the Patent Cooperation Treaty (PCT), without having to file several separate national or regional patent applications.

 

The granting of patents is the responsibility of national or regional patent offices during what is called the "national phase". Therefore, in order for your invention to be protected in Spain and in the countries in which you are interested in obtaining protection, it is necessary to file a PCT national phase application in each country within 30 months from the international filing date or priority date, as the case may be.

 

Applicants can carry out all actions relating to PCT procedures in Spanish because the SPTO acts as:
